Terms of Service

These terms govern the domain name services offered on register.com.es by Domain Registrar S.L. Please read them before placing an order. By asking us to register, renew or transfer a domain name, you accept these terms and the rules of the registry that manages that domain extension.

1. Who we are

The services are provided by Domain Registrar S.L., C/ de Calàbria 145, Esc. Izq., Entlo. 4, 08015 Barcelona, Spain. NIF B75994574, EU VAT number ESB75994574. You can reach us through register.com.es/support.

2. Services and orders

We offer registration, renewal and transfer of .es, .eu and .it domain names, together with related services such as DNS and email forwarding. The availability check on our website is an indication based on public DNS and is not an offer.

An order is a request. It becomes a binding contract only when we have confirmed with the registry that the name can be registered for you, sent you the price, and received payment. Domain names are registered on a first-come, first-served basis, and we cannot guarantee that a name will still be available when the registry processes the order. If the name cannot be registered, any amount you paid for it is refunded in full.

3. Registry rules and eligibility

Each extension is managed by a registry whose rules form part of your contract and prevail over these terms where they conflict:

.es — Red.es (dominios.es). Open to anyone, with no local presence required. See the .es terms and conditions clauses and section 14 below.
.eu — EURid. Available to citizens of the EU, and to residents and organisations established in the EU, Iceland, Liechtenstein or Norway. See the rules published at eurid.eu.
.it — Registro.it. Available to persons and organisations in the EU and EEA, as well as in Switzerland, San Marino and Vatican City. See the regulations published at nic.it.

You must meet the eligibility requirements for the extension you order, both at registration and for as long as you hold the name. A registry may suspend or revoke a name that does not comply with its rules.

4. Prices and payment

Prices are shown in euros per registration year and exclude VAT. VAT is added at the applicable rate where required; business customers established in another EU member state who provide a valid VAT number are invoiced under the reverse-charge mechanism. The price you pay is the price confirmed to you when the order is accepted.

Payment is due in full before we submit a registration, renewal or transfer to the registry. We may change our prices for future periods; if the price of a renewal changes, we will tell you at least 30 days before the renewal date.

5. Renewals and expiry

Domain names are registered for a fixed period and must be renewed before they expire. To avoid an unwanted expiry, we send reminders ahead of the expiry date and, unless you have told us not to, we will renew the name and invoice you for the next period. If you do not want a name renewed, tell us before its expiry date through support.

If a name is not renewed in time, the registry's lifecycle applies. Depending on the extension, the name may be suspended, pass through a grace, redemption or quarantine period, and then be released for registration by anyone. Restoring a name during a redemption or quarantine period may carry an additional registry fee, which we pass on at cost. We are not responsible for the loss of a name that expires because a renewal was not paid in time.

6. Transfers

Transfers in. We do not charge a separate transfer fee. Where the registry adds a registration period as part of the transfer, the renewal price for that period applies. You must be the registrant of the name, or authorised by the registrant, and provide the authorisation code issued by your current provider.

Transfers out. You may move your names to another provider at any time. We provide the authorisation code on request and do not charge for leaving. Transfers may be refused by the registry where its rules require it, for example for names that are locked, in dispute, or recently registered or transferred.

7. Cancellation, withdrawal and refunds

Once a registry has accepted a registration, renewal or transfer, it cannot be reversed, and the fees for it are not refundable except where the law requires otherwise.

If you are a consumer, you normally have a right to withdraw from a distance contract within 14 days. Because a domain registration is carried out in full as soon as the registry accepts it, you ask us to begin performance immediately when you place an order, and you acknowledge that you lose the right of withdrawal once the service has been fully performed, as provided in Article 103(a) of the Spanish General Law for the Defence of Consumers and Users. Any request you withdraw before we submit it to the registry is refunded in full.

8. Your responsibilities

Provide complete and accurate registrant and contact details, and keep them up to date for as long as you hold the name.
Make sure that registering and using the name does not infringe trademarks or other rights of third parties. We do not check names against third-party rights and are not responsible for disputes over them.
Use the name and our services lawfully, and not for spam, phishing, malware, fraud or other abuse.
Keep any credentials, API keys and authorisation codes we give you confidential.

9. Abuse, complaints and disputes

To report abuse involving a name we manage (such as phishing, malware or spam), or to make a complaint about our service, contact us through support with as much detail as possible. We investigate every report and, where appropriate, act in line with the rules of the relevant registry and applicable law.

Disputes between a registrant and a third party over rights in a domain name are resolved through the procedures set by each registry, including the out-of-court dispute resolution procedure for .es names published at dominios.es, the alternative dispute resolution procedure for .eu names, and the reassignment procedure for .it names. The outcome of those procedures is binding in accordance with the registry's rules, and we will implement it.

10. Suspension

We may suspend services for a name where payment is overdue, where the registrant data is false or cannot be verified, where the name is used for abuse, or where a registry, court or competent authority requires it. Where possible we will tell you beforehand and give you an opportunity to fix the problem.

11. Limitation of liability

We provide our services with reasonable care and skill. To the extent permitted by law, Domain Registrar S.L. is not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill, or for loss caused by registry decisions, failures of third-party systems, or events outside our reasonable control. Our total liability in connection with a name is limited to the fees you paid for that name in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability for wilful misconduct or gross negligence, or any rights you have as a consumer that cannot be excluded by contract.

12. Changes to these terms

We may update these terms, for example to reflect changes in registry rules or the law. The version published on this page applies to orders placed after its publication date. If a change materially affects services you already hold, we will notify you at least 30 days in advance, and you may transfer your names out before it takes effect.

13. Governing law and contact

These terms are governed by Spanish law. If you are a consumer, you may bring proceedings in the courts of your place of residence and keep the protection of the mandatory rules of the country where you live. Otherwise, the courts of Barcelona, Spain have exclusive jurisdiction.

14. Additional terms

14.1 Terms of application in the registry of domain names .ES (Annex III)

The applicant for a domain name (hereinafter, "the Applicant") states that:

14.1.1. The Applicant knows and accepts the prevailing regulations and procedures, terms and conditions, fees, payment methods and technical requirements established for the registration of domain names under the ".es" country code, the contents of which are available at www.dominios.es.
14.1.2. The Applicant is aware that any breach of these regulations, in cases where expressly stipulated, will lead to the loss of the domain name and its possible immediate reassignment and registration in favour of another legally entitled applicant.
14.1.3. The details provided in the present application are true, barring errors and omissions made in good faith.
14.1.4. The Applicant commits to keeping the information provided in this application always up to date and to notifying Red.es of any changes that take place. Failure to comply with this obligation may give rise to the domain name being cancelled, in keeping with the procedure laid down for such purposes (for example, it being impossible to contact the people listed as responsible for the domain name because they have not reported changes in their contact details or in those responsible for the domain).
14.1.5. The Applicant accepts that when carrying out the different procedures involved in assigning and managing the domain name, Red.es will act based on the data provided by the Applicant as indicated in the previous section.
14.1.6. The Applicant is aware and accepts that any falsehood in the details provided in this application may be cause for cancellation of the domain name, in keeping with the procedure established for these purposes, and that, in this case, said domain will become available for subsequent registration by another legally entitled applicant.
14.1.7. The Applicant is aware and accepts that once the Registry notifies them that the domain may be assigned or renewed because it fulfils the requirements established for this purpose, the Applicant is obliged to pay the corresponding fee for domain name assignment or renewal, where applicable, by the set deadline.
14.1.8. The Applicant is aware and accepts that in the event of non-payment or insufficient payment by the stipulated deadline, the domain name will become available from that time for registration in favour of a legally entitled applicant.
14.1.9. The Applicant is aware and accepts that in the event of a breach of the rules and technical conditions set out by the Assignment Authority for the proper functioning of the ".es" domain names system, a domain name may be deregistered, either temporarily or permanently.
14.1.10. To the best of the Applicant's knowledge, the use of the domain name does not violate the rights of third parties.
14.1.11. The Applicant is aware and accepts that the assignment of the ".es" domain name entails submission to the out-of-court dispute resolution procedure on the use of domain names in relation to industrial property rights protected in Spain, such as trade names, registered trademarks, designations of origin and company names, or in relation to the official or generally recognised names of Spanish public entities, in compliance with the procedure set forth in the regulations for the out-of-court dispute resolution procedure regarding the use of ".es" domain names, published on the website www.dominios.es.
14.1.12. The Applicant is aware and accepts that the outcomes of the out-of-court dispute resolution procedure will be binding on the parties and on the Assignment Authority.
14.1.13. The Applicant is aware and accepts that assignment and registration of a domain name confers the exclusive right to use it for addressing purposes within the Internet domain names system, under the terms set forth in the applicable legislation.
14.1.14. The Applicant states that the administrative contact person stated in the application has sufficient powers of representation and accepts that this person is responsible in the event of any incident related to the domain name's rights of use, and that said person is aware of and accepts this responsibility.
14.1.15. The Applicant declares that all entities and persons listed in this application are aware, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), of the following basic information on the protection of their personal data:

Purpose
Management of relations for the allocation of domain names and relations with owners and/or authorised registration agents. Re-use of information associated with ".es" domain names in accordance with Law 37/2007, of 16 November, on the re-use of public sector information. Preparation of reports, studies and additional analyses on the use of ".es" domains by Red.es or, jointly, with other Spanish or international organisations or entities involved in the management of domain names. Collaboration agreements with other Spanish Public Administrations or entities, as well as with international bodies or organisations with which Red.es signs agreements within the scope of its competencies. Maintenance of contractual relations with registration agents and domain owners. The legitimate interest of Red.es and of third parties in knowing the degree of use and purposes of .es domains.

Security measures
The security measures implemented in the public business entity Red.es, M.P. correspond to those provided for in Annex II (Security measures) of Royal Decree 311/2022, of 3 May, which regulates the National Security Scheme in the field of Electronic Administration, and the security controls of the Information Security Management System based on the UNE-EN ISO/IEC 27001 standard have also been implemented. Third parties with contractual relationships with the Registry apply the same or equivalent measures.

International transfers
International transfers are envisaged with entities that have a contractual relationship with the Registry and for reasons of public interest (security of the Registry). Details of such contractual relationships may be consulted in an annex to this sheet.

Exercise of rights
You may exercise your rights of access, rectification, erasure and portability of your data, and restriction of or objection to its processing, by completing a form available at the electronic headquarters of Red.es addressed to the data controller (Red.es): sede.red.gob.es, or by email to protecciondedatos@red.es.

14.1.16. The Applicant declares that all the entities and persons listed in this application expressly consent to their personal data being provided to the REGISTRAR and to the data included in this document being processed by Red.es for the following purposes: registration of the data necessary for the assignment, operation and renewal of the domain name; registration in internal databases for the management of the ".es" Register (.es Domains); and communication to other Public Authorities with which Red.es enters into agreements.
14.1.17. All this in accordance with the terms established in the Rules and Procedures for the Registration of a Domain Name under ".es".
14.1.18. The Applicant declares that all entities and persons listed in this application are aware that, in accordance with Additional Provision Eighteen of Law 14/2000, of 29 December, on Fiscal, Administrative and Social Order Measures, the Public Corporate Entity Red.es will publicise the procedures for the assignment and registration of ".es" domain names that are adopted, and that this will imply that the forename and surnames, in the case of natural persons, the trade name, in the case of legal persons, and the email address in all cases, will be communicated through WHOIS, the TCP protocol for queries and responses regarding said data, as well as through those tools that Red.es enables for queries relating to that data.
14.1.19. The Applicant is aware of and accepts that the rights of access, rectification, erasure and portability of data and the restriction of or objection to the processing thereof may be exercised directly vis-à-vis Red.es as data controller. The rights of erasure or objection may only be exercised once the application for the domain name has been withdrawn, since it is necessary for Red.es to process personal data for the purpose of assigning or renewing the domain name.
14.1.20. Red.es, whose website address is www.red.es, shall comply with the provisions of Regulation (EU) 2016/679 on the processing of personal data of the aforementioned persons and entities, without using them for any purpose other than the assignment and renewal of the domain name and its publicity in the terms described above. The personal data processed by Red.es will not be transferred to or be accessible by any other third party, unless such transfer is required by law, by a regulatory provision or by a court ruling, or if this disclosure is necessary to ensure the protection and defence of its rights. Red.es, in registering the ".es" domain name, has the authority to outsource services related to correct registration, such as development, operation, attending to registrars and end users, and security. In these circumstances, the subcontractors of Red.es will be subject to the same clauses of confidentiality and personal data processing.
